1- INTRODUCTION

The general conditions of sale are detailed below (indicated in the ” General Conditions “). They govern the contractual relations entered by every user of the site www.dazzle-dive.com (below indicates ” The customer ” and the commercial banner Dazzle-dive) of Dazzle Dive Limited, company of Hong Kong law, head office of which is located Unit 1010, Miramar Tower, 132 Nathan Road, Tsimshatsui, Kowloon, Hong Kong, registered under n° 1754265.

By doing business with www.dazzle-dive.com, you make a commitment to respect the General Conditions as well as Terms of service appearing there.

2-PRODUCTS

2.1: Availability:

You will note that your order is considered as validated of that we shall have received the confirmation by one or several operators of the availability of places, the type of cabins, dates, course which you have reserved. In the situation where one of the criteria ordered would not be available, we make a commitment to contact you by e-mail within 48 hours as from the date of your order to inquire and indicate to you what solution we propose you.

2.2: Booking:

A booking will be confirmed when the customer will has received a written confirmation from Dazzle Dive Limited. The customer will receive an invoice, the confirmation of their booking and a booking form by email. For bookings of groups, please indicate the names of the couples and the single guests for the allowance of cabins.

2.3: Price :

The selling prices indicated on www.dazzle-dive.com are inclusive of all taxes. According to the currency chosen by the operator the basic price will be the one indicated in the currency on every product sheet. The price in Euro, Thai Baht or $US to give an idea of the price the closest possible to the reality. The real price being worked out again at the time of the publishing of our Profroma Invoice by means of web site of our HSBC Bank. Any change of the rate of the various markets (THB Thailand/ RM – Malaysia / IDR – Indonesia / PHP – philippines) can be echoed on the price of products or services. Dazzle Dive Limited reserves the right to modify its rates at anytime, however understood that the price discussed during our Internet exchanges (mail and\or real-time chat on skype) will be the only one applicable to the buyer.

3- ORDER

3.1 : Conditions of payment :

The payment must be settled within 7 days after receipt of the invoice. The payment can be made via Paypal or bank transfer for the attention of Dazzle Dive Limited. We charge all extra cost on payment by Paypal, please be aware that some banks do charge for transfer and this is not at the cost of Dazzle Dive Limited. In every case, the sale contract is considered concluded only at the time of the debit of the account of the customer.

3.2: The Consumer or « user » :

The customer has the responsability to arrange all the necessary authorizations for the purposes of use of the method of payment which they chose during the validation of their order.

They makes besides a commitment to make sure of the solvency before any order, fault for the Dazzle Dive Limited to be able to proceed to the registration of the order.

The website www.dazzle-dive.com reserves the possibility of suspending or of cancelling any order in case of refusal of authorization of payment on behalf of the financial bodies questioned according to the method of payment chosen by the consumer.

Also, it reserve the right of refusing to take into account a order emanating from an Internet user with whom a relative dispute notably in the payment of a previous order is outstanding. 4- SECURE PAYMENT

Dazzle Dive Limited provides you with 2 systems of payment:

Paypal by Credit card (Visa or Mastercard). In the currency of your choice ($US – € – THB)

Wire Transfer on our Bank Account in Hong Kong. In the currency of your choice ($US – € )

For payment by credit card, to insure your satisfaction, no change is made on the bank card is made before the availability of places is confirmed by the operator, only a demand of authorization will be made to check if your credit card is valid and reliable. The actual collection will only start once the confirmation of the operator for cabins, dates and courses has been confirmed.

5- CONDITIONS OF CANCELLATION

5.1: Cancellation terms:

cancelation terms are edited by operators of your cruise or resort and will be notify in your quotation.

No refund in case of plane delays, mechanical problems, sea and weather conditions, illness, accident, strike, war, criminals, acts, terrorist action, natural disaster, quarantine, change of government policy regarding visas and therefore out of control of Dazzle Dive Limited

In the eventuality where the operator is obliged to cancel or to interrupt the cruise because of mechanical problems or insufficient customers or any reasons independent of our will, we make a commitment to reserve you to another boat of the same range and same price (If available) or proceed to refund of your cruise or resort stay by bank transfer or paypal.

The demand of cancellation by customer must be written and sent in Dazzle Dive Limited by Email: contact@dazzle-dive.com

Note : We don’t accept cancellations made by phone.

5.2: Assurance of cancellation

We highly recommend that each participant subscribes to a cancellation insurance covering: travel cancellation, accident, luggage lost. Note if you decide not to subscribe a travel insurance, we won’t be held responsible from any financial disappointment due to independents reasons of our will.

6- GENERALS CONDITIONS

6.1: Generales Conditions :

Diving courses :

Dazzle Dive Limited is not held responsible for the success of the diving courses of the customer during the training they follow. The success of the diving course and certification are under the responsability of the diving instructor. The certification can be acquired only if the customer fulfills the conditions defined by Padi standards. The customers recognize that they have to fill the conditions expressed in the standards Padi to join a Padi course.

Certified Divers :

Customers have to meet a minimum requirement of been PADI Open Water Diver, CMAS 1* or equivalent to take part in diving activities. Customers recognize they must stop diving 18h00 hours before flying. The diving crew can refuse the diving practice of a participant if they don’t hold a certification of at least Open Water Diver PADI, CMAS 1* or equivalent. The customer when requested must show their certification card, log book, medical statement. The dive schedule during diving trip ” A la carte” is flexible if change occur before 17h00 the day before the diving trip. If the customer registered to a day trip and doesn’t show up at the boat departure, no refund will be made

Liveaboard :

Customers be responsible to respect security rules given by the boat’s Tour Leader. The customers will be forbidden to dive if they do not respect the safety regulations given by the Boat’s Tour Leader. The diving crew reserves the right to change the schedule or the choice of the dive sites according to the sea and weather conditions, or if the technical or physical level of the customers is not bespoke to the conditions. Customers promise not to hold Dazzle Dive Limited responsible of the number of dives made or change of schedule. No refund will be possible if customers don’t respect the security rules given by the Tour Leader or if customers don’t hold their certification card to show.

6.2: Diving Accident, Insurance

Dazzle Dive Limited is not held responsible for diving accidents or other accidents which can occurred during the diving trip. Customers recognize they should dive in their training limits and experience following the instructions given by the dive crew.

We highly recommend to make a contract with a personnal scuba diving insurance, such as Divers Alert Network.

7- LITIGATION AND RESPONSABILITIES

This present contract is submitted to Thai law.

9- PROTECTION PERSONNALS DATAS

The information which you communicate us is indispensable for the treatment and the routing of the orders and the issuing of invoices, their absence can lead to the cancellation of your order. By registering you on www.dazzle-dive.com, you make a commitment to supply us with sincere and genuine information concerning you. The communication of false information is against the present general conditions as well as in the conditions of use appearing on the site www.dazzle-dive.com.

According to the law ” Computing and Liberties “, the treatment of your information was the object of a statement with the National Committee of the Computing and with the Liberties number (CNIL). Dazzle Dive Limited is authorized to take, and handle the information concerning you. This data is the object of an IT processing.

This activity is strictly regulated: the file was declared to the IT National Committee and Liberties under the number of receipt 1541251.
